Peremptory challenges on the basis of gender were a violation of the Sixth Amendment.
In the case of JEB v. Alabama ex rel. T.B., the Supreme Court ruled that using peremptory challenges to exclude jurors based on their gender violated the Sixth Amendment right to a fair trial. This ruling was based on the principle that jurors should be selected based on their ability to be fair and impartial, rather than on characteristics such as gender. Discrimination based on gender in jury selection undermines the integrity of the justice system and was therefore deemed unconstitutional.
