The Radical Republicans gained two-thirds control of both the U.S. Senate and the House in the fall of 1866. They were then able to pass Reconstruction Acts that placed the control of Reconstruction under Congress and the United States Army.

Under the Reconstruction Act, Texas had to register all eligible voters. This included the freedmen. Texas also had to construct a new state constitution, and establish local and state governments that followed the new constitution. In addition, it had to elect representatives and senators for the U.S. Congress and ratify the Fourteenth Amendment.
